Terms of Service

These terms are a binding agreement between you and ARC Proxies. They explain what you are buying, what you may and may not do with it, and what happens if something goes wrong. Section 8 (Acceptable Use) and Section 9 (Withdrawal and Refunds) matter most — please read them.

1.Who we are

The Services are provided by Ravaiq Ltd., a limited company incorporated in the Republic of Cyprus, registration number HE485497, with its registered office at Soliou 2, 8560 Peyia, Cyprus, VAT identification number CY60305081D (trading as “ARC Proxies”, “we”, “us”).

You can reach us at contact@arcproxies.io or through our Discord server, which is our primary support channel.

For the purposes of Articles 11 and 12 of the Digital Services Act, our single point of contact for authorities and for users is contact@arcproxies.io. Communications may be in English.

2.Definitions

  • Services — the proxy network, the bandwidth you purchase, the customer dashboard and anything else we make available to you.
  • Bandwidth — the quantity of data transfer, measured in gigabytes (GB), that you purchase and that is credited to your account.
  • Credentials — the username, password and connection string that authenticate your traffic on our network.
  • You — the person or entity that registers an account, whether acting as a consumer or in the course of a business.

3.Agreement to these terms

By creating an account, purchasing Bandwidth or using the Services, you agree to these terms. If you do not agree, do not use the Services.

If you are entering into these terms on behalf of a company or other legal entity, you confirm that you are authorised to bind that entity, and “you” refers to that entity.

4.Eligibility and your account

  • You must be at least 18 years old to use the Services.
  • You must provide accurate registration information and keep it up to date. Providing false information is grounds for termination under Section 11.
  • You are responsible for everything that happens under your account and through your Credentials, including traffic sent by anyone you allow to use them.
  • You must keep your Credentials confidential and tell us immediately if you believe they have been compromised.
  • We may require verification of your identity or intended use before enabling the Services, and may decline to open an account without giving reasons.

5.What we provide

We sell Bandwidth on a per-gigabyte basis across our residential proxy network. Each purchase is a one-time purchase. There is no subscription and no recurring charge.

  • Bandwidth you purchase does not expire. It stays credited to your account until you use it.
  • Bandwidth is credited to your account only. It is not transferable to another account, has no cash value, and cannot be exchanged, sold or refunded for money except as required by law.
  • We provide the Services with reasonable skill and care, but we do not guarantee any specific level of uptime, speed, latency, success rate or IP availability unless we have separately agreed one with you in writing.
  • Our network relies on third-party infrastructure and upstream providers. Interruptions, changes or failures at that layer may affect the Services, and Section 13 applies to them.

6.Prices, taxes and payment

  • Prices are shown in euros (EUR) and are exclusive of VAT unless stated otherwise. VAT is calculated and displayed at checkout according to your status and location.
  • Volume discounts are applied automatically at checkout based on the quantity purchased. The price shown at checkout before you confirm is the price you pay.
  • Payment is processed by Stripe. We do not receive or store your full card details. Stripe's own terms apply to the payment itself.
  • Bandwidth is credited once payment is confirmed. If a payment is reversed, charged back or fails after crediting, we may suspend your account and remove the corresponding Bandwidth.
  • We may correct obvious pricing errors before a purchase is completed. If a price was clearly wrong and you could reasonably have recognised it as such, we are not bound by it.

7.Discounts and promotional codes

Promotional codes, including any welcome discount, are valid only as stated at the time of the offer, may be limited to one redemption per account or per person, cannot be combined unless we say so, and may be withdrawn at any time before a purchase is completed. We may refuse or reverse a discount obtained through duplicate accounts or other circumvention.

8.Acceptable use

You may use the Services only for lawful purposes. You are responsible for the legality of your traffic — both under the law that applies to you and under the law that applies where your traffic terminates.

You must not use the Services to:

  • commit, facilitate or conceal any criminal offence, or any activity that is unlawful in Cyprus, in the European Union, or in the jurisdiction of the systems you connect to;
  • gain or attempt to gain unauthorised access to any system, account or network — including hacking, credential stuffing, brute-force attacks, exploitation of vulnerabilities, or bypassing authentication;
  • launch or participate in any denial-of-service or distributed denial-of-service attack, or send traffic whose purpose or effect is to degrade, overload or disrupt any system;
  • distribute malware, ransomware, spyware, or operate a botnet or command-and-control infrastructure;
  • send spam or unsolicited bulk messages, or conduct phishing, pharming, social engineering or any other deceptive campaign;
  • commit fraud of any kind, including payment fraud, carding, testing stolen payment instruments, account takeover, identity theft, click fraud or advertising fraud;
  • access, transmit or store child sexual abuse material, content depicting non-consensual sexual activity, or content promoting terrorism or mass violence. We report such activity to the competent authorities without notice to you;
  • harass, stalk, threaten, defame or dox any person;
  • infringe the intellectual property rights, trade secrets or privacy rights of any person;
  • collect personal data in breach of applicable data protection law, or process it in a way that would make us a controller of that data without our agreement;
  • circumvent economic sanctions or export controls, or use the Services from, or to route traffic to, a jurisdiction subject to comprehensive EU sanctions;
  • resell, sublicense, rent, lease, share or otherwise make the Services or your Credentials available to any third party (see Section 10);
  • misrepresent the source or nature of your traffic to us, or evade a suspension or ban.

Scraping and automated collection of publicly accessible data is a legitimate use of the Services and we do not prohibit it as such. However, you remain responsible for ensuring that your specific activity is lawful — including under applicable data protection, computer misuse, contract and copyright law.

9.Right of withdrawal and refunds

If you are a consumer in the European Union:

You normally have the right to withdraw from a distance contract within 14 days without giving a reason. Bandwidth is digital content supplied otherwise than on a tangible medium, and it is made available to you immediately.

At checkout, you are asked to give your express prior consent to us beginning performance immediately, and to acknowledge that you thereby lose your right of withdrawal. If you give that consent and we make the Bandwidth available to you, your right of withdrawal is extinguished and the purchase is final.

If you do not give that consent, we will not make the Bandwidth available until the 14-day period has passed.

Refunds generally:

  • Because Bandwidth is made available immediately and does not expire, purchases are non-refundable once the Bandwidth has been credited to your account.
  • Unused Bandwidth is not refunded in money. It remains on your account indefinitely and you may use it at any time.
  • If your account is suspended or terminated because you breached Section 8, you are not entitled to any refund and any remaining Bandwidth is forfeited.
  • None of this limits your statutory rights where the Services are defective or not as described. If we fail to provide what you paid for, contact us and we will put it right.

10.No resale, no sharing

The Services are licensed to you for your own use. You may not resell, sublicense, rent, share or otherwise make the Services or your Credentials available to any third party, and you may not act as a reseller of our Bandwidth, whether or not for profit, without our prior written agreement.

If we agree to a reseller arrangement with you, it will be set out in a separate written agreement and these terms will apply to it only so far as that agreement does not say otherwise.

11.Suspension and termination

We may suspend or terminate your account, immediately and without prior notice, if:

  • you breach Section 8 (Acceptable Use), or we have reasonable grounds to believe you have;
  • we are required to do so by law, by a competent authority, or by an upstream provider;
  • your traffic threatens the integrity, security, reputation or lawful operation of our network;
  • you provided false registration or verification information;
  • a payment is reversed or charged back;
  • you attempt to resell or share the Services in breach of Section 10.

Where the breach is not serious and it is reasonable to do so, we will give you an opportunity to remedy it first. Where the breach is serious — in particular anything in Section 8 involving criminal activity — we will not.

You may stop using the Services and close your account at any time. Closing your account does not entitle you to a refund of Bandwidth already credited.

12.Our role: mere conduit, and your responsibility for your traffic

We transmit your traffic. We do not originate it, direct it, or read it.

In providing the Services we act as a mere conduit within the meaning of Article 4 of Regulation (EU) 2022/2065 (the Digital Services Act). Specifically, in respect of the information transmitted through our network:

  • we do not initiate the transmission — you do;
  • we do not select the receiver of the transmission — you choose what you connect to;
  • we do not select or modify the information transmitted.

We do not store copies of the information you transmit beyond what is technically necessary to carry it, and we do not retain it for any longer than the transmission reasonably requires. We are therefore not liable for the information transmitted, and we are under no general obligation to monitor it or to actively seek facts indicating illegal activity (Article 8 DSA).

This does not affect the ability of a court or a competent administrative authority to require us to terminate or prevent an infringement. We comply with lawful orders and with valid notices, and we will act on them — including by suspending or terminating an account under Section 11.

Because we are a conduit, responsibility for the traffic is yours.

As between you and us, you are solely responsible for what you send through the Services, for the systems you connect to, and for the consequences of both. Nothing in this Section relieves you of your obligations under Section 8, and nothing in it may be relied on by you as permission to send unlawful traffic.

You agree to indemnify us against any claim, penalty, loss or cost (including reasonable legal fees) arising from your use of the Services in breach of these terms or of applicable law. This does not apply to the extent the claim results from our own breach, negligence or wilful misconduct, and — where you are a consumer — it applies only to the extent permitted by law.

13.Availability, and limits on our liability

We work to keep the Services available, but we do not warrant that they will be uninterrupted, error-free, or that any particular target will be reachable. Proxy performance depends on factors outside our control, including the behaviour of the sites you connect to.

Nothing in these terms limits our liability for:

  • death or personal injury caused by our negligence;
  • fraud or fraudulent misrepresentation;
  • any liability that cannot be limited or excluded under applicable law — including, where you are a consumer, your mandatory statutory rights.

Subject to that:

  • we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profit, revenue, data, goodwill or anticipated savings, however caused;
  • we are not liable for interruptions, degradation or failures originating in third-party infrastructure or upstream providers;
  • our total aggregate liability arising out of or in connection with the Services is limited to the total amount you paid us in the twelve (12) months preceding the event giving rise to the claim.

If you use the Services in the course of a business, you accept that this allocation of risk is reflected in our prices.

14.Intellectual property

We own the Services, our software, our dashboard, our documentation and our brand, including the name and logo ARC Proxies. Nothing in these terms transfers any of that to you. You receive only a limited, non-exclusive, non-transferable right to use the Services in accordance with these terms.

You may not copy, modify, reverse-engineer or create derivative works of the Services, except to the extent that applicable law expressly permits it despite this restriction.

15.Data protection

We process personal data in accordance with the GDPR. What we collect, why, how long we keep it and what rights you have is set out in our Privacy Policy, which forms part of these terms.

If your use of the Services involves processing personal data of third parties, you are the controller of that data and you are responsible for having a lawful basis for it. We are not your processor for that data unless we have signed a data processing agreement with you.

16.Force majeure

Neither party is liable for a failure to perform caused by an event outside its reasonable control, including natural disaster, war, terrorism, civil unrest, strike, epidemic, failure of public telecommunications networks, government action, or a large-scale attack on internet infrastructure. If such an event continues for more than 30 days, either party may terminate the agreement, and we will refund any Bandwidth that we were unable to make available to you.

17.Changes to these terms

We may change these terms — for example, to reflect a change in the law or in the Services. We will publish the amended terms here and update the “last updated” date. Where a change is material and affects you adversely, we will give you at least 30 days’ notice by email before it takes effect.

Changes do not apply retroactively to Bandwidth you have already purchased. If you do not accept a material change, you may stop using the Services and close your account; Section 9 still governs whether any refund is due.

18.Governing law and disputes

These terms and any dispute arising out of them are governed by the law of the Republic of Cyprus, and the courts of the District Court of Paphos, Cyprus have exclusive jurisdiction.

If you are a consumer resident in the European Union, this choice of law does not deprive you of the protection of the mandatory consumer law of the country where you live, and you may also bring proceedings in the courts of that country.

The European Commission provides an online dispute resolution platform at ec.europa.eu/consumers/odr. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

This does not take anything away from you: you keep every right in this Section, including the right to bring a claim in the courts of the country where you live.

19.Miscellaneous

  • If any provision of these terms is found to be invalid or unenforceable, the rest remains in force and the invalid provision is replaced by one that comes closest to its commercial intent.
  • Our failure to enforce a provision is not a waiver of it.
  • You may not assign your rights under these terms without our consent. We may assign ours to a successor of our business.
  • These terms, together with the Privacy Policy, are the entire agreement between us regarding the Services.
